Superannuation

In many cases, yes. Under Australian law, performers and entertainers are often treated as employees for superannuation purposes even when they invoice as a contractor, depending on how the engagement is structured. Whether super applies, and who is responsible for it, depends on the arrangement between the band, the venue or client, and any agency involved.

It depends on the booking structure. When a booking goes through Bands Australia under our facilitated arrangement, we manage the applicable superannuation obligations where they apply, so the band does not have to chase it. For direct bookings between a band and a client, responsibility generally sits with whoever is treated as the paying entity under the relevant rules. If you are unsure, we are happy to talk it through.

This is where bands differ from solo acts. A single performance fee is often split between several members, and super may apply to each member's share depending on their individual situation and how they are engaged. Some members invoice through their own ABN, some are paid as individuals, and band leaders sometimes invoice for the whole group. Because every band is set up differently, the correct treatment can vary member by member.

Substitutes and casual fill-ins can change the picture. A musician brought in for a single show may be treated differently from a regular member, and their super position can depend on who engages and pays them. If your band regularly uses subs, it is worth getting the arrangement reviewed so everyone knows where they stand.
